Triple Aught Design (also “us,” “our,” or “we”) is committed to respecting the privacy rights of all visitors to our website tripleaughtdesign.com (“Site”). The following describes how Triple Aught Design collections protects and uses information we receive from visitors to our Site.


By accessing or using our Site, you agree to the terms of this Privacy Policy. If any portion of this Policy is unacceptable to you, do not use the Site. Use of the Site constitutes acceptance of this Privacy Policy, including any future revisions to this Privacy Policy.


WHAT INFORMATION DOES TRIPLE AUGHT DESIGN COLLECT AND HOW DO WE USE IT?

When ordering products on our Site, we need you to provide your name, email address, billing and mailing addresses, phone number and credit card information. This information is required for us to process customer transactions. Providing a password allows us to provide a faster method for you to place subsequent orders.  There is no cost to create an account with us.


E-Mail. If you choose to join Triple Aught Design's mailing list, we will collect your email address, name and gender, and use these details to provide marketing or promotional content to you. You may opt out of our mailing list at any time by clicking on the "Unsubscribe" link at the bottom of any newsletter, or by contacting our Customer Support team using the information below. Registering for an account on our Site does not automatically subscribe you to our mailing list.


SMS. If you provide a mobile telephone number to us, we may use this number to send you transactional or informational SMS messages regarding your account, any order you place on the Site, or items left in a shopping cart that you do not purchase. You may have the option to receive marketing SMS messages from us.  You may opt out at any time from receiving marketing SMS messages by replying STOP or END to such messages.  But this opt out will not stop informational or transactional messages from us.  


Promotions.  When you enter a contest or other promotional feature, Triple Aught Design may again ask for your name, address, email address, username and password so that we are able to better administer the contest and notify winners.


We may also use the information we collect during the registration process to occasionally notify you about important functionality changes to the Site or new Triple Aught Design services.

When you interact with our Site, we also collect limited non-personally identifying information that the browser you used makes available automatically. This information includes the internet address of the computer or network you used to access our Site, the date, time, and page(s) you visited on our Site, the browser and operating system you used, and the referring page (the webpage that contained the link to our Site that you clicked on to get there).  We also use data files to help you navigate on the Site. Once you leave our Site, you have the right not to be followed. Please see our section on Cookies below to learn more about managing your experience.  

We may collect your email address via cookies and pixels on the Site through the use of trusted third-party partners.  These partners may combine your email information with other information they have access to such as your mailing address so that we may serve relevant marketing offers to you via direct mail. If you do not want us to collect information about you, please contact us to opt out.

If you call, email or chat with our Customer Care, we may ask for information such as your name, email address, mailing address, telephone number and if you choose to make a purchase, your credit card information. We use this information to assist you and to process or review your transaction. When you place an order through our Customer Care, you will be asked to provide your credit card information. We do not store your credit card information unless you choose to include it in your “My Account”.

CALIFORNIA PRIVACY RIGHTS (CALIFORNIA CIVIL CODE SECTION 1798.83)

A California resident who has provided personal information to a business with whom he/she has established a business relationship for personal, family, or household purposes ("California customer") is entitled to request information about whether the business has disclosed personal information to any third parties for the third parties' direct marketing purposes. In general, if the business has made such a disclosure of personal information, upon receipt of a request by a California customer, the business is required to provide a list of all third parties to whom personal information was disclosed in the preceding calendar year, as well as a list of the categories of personal information that were disclosed.


However, under law, a business is not required to provide the above-described lists if the business adopts and discloses to the public (in its privacy policy) a policy of not disclosing customer's personal information to third parties for their direct marketing purposes unless the customer first affirmatively agrees to the disclosure, as long as the business maintains and discloses this policy. Rather, the business may comply with the law by notifying the customer of his or her right to prevent disclosure of personal information and providing a cost free means to exercise that right.


As a general matter , we do not share information with third parties for their direct marketing purposes unless you affirmatively agree to such disclosure, typically by opting in to receive information from a third party. If you do ask us to share your information with a third party for its marketing purposes, we will only share information in connection with that specific promotion, as we do not share information with any third party on a continual basis. To prevent disclosure of your personal information for use in direct marketing by a third party, do not opt in to such use when you provide personally identifiable information on one of our sites. Please note that whenever you opt in to receive future communications from a third party, your information will be subject to the third party's privacy policy. If you later decide that you do not want that third party to use your information, you will need to contact the third party directly, as we have no control over how third parties use information. California customers may request further information about our compliance with this law by contacting Customer Support. Please note that we are only required to respond to one request per customer each year and we are not required to respond to requests made by means other than through this email address.


HOW DOES TRIPLE AUGHT DESIGN PROTECT VISITOR INFORMATION?

We take reasonable and appropriate security measures to protect unauthorized access, alteration or destruction of data located on and collected by our Site. We exercise reasonable care to protect your non-public personal information at rest. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. While we strive to protect your non-public personal information, we cannot guarantee the security of any information you transmit to us or receive from us while it is in transit. Once we receive your personal information, we maintain commercially reasonable physical, electronic, and procedural safeguards to protect it. If a data breach occurs, we will, if required by applicable law, promptly notify you and the proper legal authority.  All sensitive/credit information supplied by users is transmitted via Secure Socket Layer (SSL) technology.


DOES TRIPLE AUGHT DESIGN USE "COOKIES"?

Yes. Cookies are small files that a site or its service provider transfers to your computer's hard drive through your Web browser (if you allow) that enables the Site's or service provider's systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart. They are also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about site traffic and site interaction so that we can offer better site experience and tools in the future. We may contract with third-party service providers to assist us in better understanding our site visitors. These service providers are not permitted to use the information collected on our behalf except to help Triple Aught Design conduct and improve its business. Google Analytics is a third-party service provider that Triple Aught Design works with to help analyze and improve how visitors interact with our website and services. They use cookies to gather anonymous data about our visitors on Triple Aught Design's behalf. They do not collect personally identifiable information like email, credit card number, phone number, or name.


DOES TRIPLE AUGHT DESIGN DISCLOSE THE INFORMATION IT COLLECTS FROM USERS TO OUTSIDE PARTIES?

Triple Aught Design does not sell, trade, or otherwise transfer to outside parties your personally identifiable information unless we provide you with advance notice, except as described below. It also does not include website hosting partners and other parties who assist us in operating our website, conducting Triple Aught Design's business, or servicing you as long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or other rights or safety. This information is also used to better understand visitor's use of Triple Aught Design's website and to support related transactions made on the website.


However, this data in aggregate form may be provided to other parties for marketing, advertising, or other uses. Triple Aught Design may also use email addresses and other personally identifiable information to contact visitors who communicate with us. For example, we direct email to visitors who provide us with their email addresses for specific purposes such as receiving our email newsletters or being notified if they have won one of our contests. Each email newsletter always contains instructions on how to discontinue receipt of the newsletter. However, if a visitor at anytime chooses to no longer receive such information and opt-out from any future mailings, they should simply click the unsubscribe link on any Triple Aught Design email sent to them and follow the instructions provided.


In the event Triple Aught Design goes through a business transition or transaction, such as a merger, acquisition, liquidation, or sale of all or a portion of our assets, your data will, in most instances, be part of the assets transferred to a successor entity.  We or the successor entity may notify affected users of such transfer.

In an attempt to provide increased value to our visitors, Triple Aught Design may choose various third party websites to link to from our own Site. However, Triple Aught Design has no control over these linked websites which each have separate privacy and data collection practices, independent of Triple Aught Design. Triple Aught Design has no responsibility or liability for these independent policies or actions and is not responsible for the privacy practices or the content of such websites. These linked websites are only for your convenience, and you therefore access them at your own risk. Nonetheless, we seek to protect the integrity of our website and the links placed upon it and therefore we request feedback on not only our own website, but for websites we link to as well (including if a specific link does not work).


SITE HOSTED IN THE UNITED STATES; CONSENT FOR COLLECTION AND PROCESSING

This Site is hosted in the United States.  The country or jurisdiction in which you reside or from which you access the Site may have privacy laws that provide greater protections for your information than those in the United States.  By accessing and using this Site from a location outside the United States, you understand and unambiguously agree that we and our third-party service providers may collect, store, and process your information in the United States.


DO-NOT-TRACK SIGNAL

Because a browser’s do-not-track signal does not often reflect the preference of our consumers, our Site does not respond to it. You may, however, elect not to receive marketing messages and/or have certain cookies placed on your browser, as discussed in this Privacy Policy.

 

CHILDREN’S ACCESS

Our Site is a general audience website, intended for adult use only.  We do not market to and do not knowingly collect personally identifiable information from children under the age of 13. Right of Access

You are entitled to access your personal information and to have it amended, updated, or deleted, where such information is incorrect, incomplete or outdated.  You may exercise your right to access your information and obtain:

  2. a description of the business purpose for which we have collected such personal information;
  3. a description of the specific pieces of personal information we have collected within the past year; and
  4. information on each third-party company to whom we have disclosed, within the past year, personal information pertaining to you for direct marketing purposes


In order to obtain such information, please contact us via the contact information provided below.  In making such request, please provide us with your name and the email address about which you are requesting information. In order to verify your identity, we may require email verification from the email address we have in our records for you. You may be required to provide more information in order for us to assist you. We will answer your request within 45 days from our receipt provided your request is complete and accurate. 


Right to Update.

If you would like to update your information, you can contact us by sending a request to the email address below.  When making a request to update your information, please provide the name and email address associated with the account. The email address you provide must match the email address we have on file for you. We will answer your request within a reasonable business period from receipt, provided that this request is complete and accurate.  You may be required to provide additional information in order for us to process your request. 


You may, on legitimate grounds, object to the processing of your personal information. Such objection may, however, prohibit us from providing the requested service. 

 

Deleting Your Account  

You can delete your account and information we keep about you (subject to certain legitimate business and legal exemptions) at any time by contacting us using the information below. 

To properly delete your account, you must provide the name under which the account was opened as well as the email address you used to create the account (names are similar, so we must have your email address to permanently delete your account). In order to verify your identity, we may require email verification from the email address we have in our records for you. 


If you are part of any loyalty program or have a credit balance on your account, and you request your account be deleted, you will lose all access to your balance and any loyalty benefits permanently, and they cannot be restored.


We retain your information for as long as it is necessary for legitimate business purposes.  We consider your continuing to receive commercial emails from us to be an ongoing relationship with you that allows your account to remain active. We consider any loyalty credits or credit balances to represent an ongoing relationship with you that allows your account to remain active.
